INTRODUCTION

This Privacy Policy describes how the above-named entity  (referred to as “we,” “us,” or “our”) collects, uses, shares, and safeguards personal information that we collect when you interact with us in person (such as at one of our facilities), or that we may collect when you visit one of our websites, use our mobile applications, communicate with us through social media, and/or use any other online service that links to this Privacy Policy (collectively, the “Services”).   We are a member of the Kraft Group of companies (the “Kraft Group”).   Privacy policies may vary by company within the Kraft Group,  This Privacy Policy applies to any information that is collected or obtained through this website or by any other means or websites that reference this policy.  Please note that this Privacy Policy does not apply to information collected if we employ you.  For information about how we handle employee data, please refer to the applicable privacy notice or seek more information from your HR supervisor.

TYPES OF INFORMATION WE COLLECT

The following provides examples of the type of information that we collect from you and how we use that information.  Note that all of our corporate affiliates may not collect the same types of information.

Although the sections above describe our primary purposes in collecting your information, in many situations we have more than one purpose.  For example, if you create an account through our mobile app, we may collect your information to perform our contract with you and/or  toy provide you with access to a rewards program, but we also collect your information for our other  legitimate interests.    As a result, our collection and processing of your information is based in different contexts upon your consent, our need to perform a contract, our obligations under law, and/or our legitimate interest in conducting our business.

SHARING OF INFORMATION

In addition to the specific situations discussed elsewhere in this policy, we may disclose information in the following situations:

  1. Affiliates and Acquisitions. We may share information with our parent organizations, subsidiaries and affiliates (e.g., sister companies, subsidiaries, joint ventures, or other companies under common control) for use in accordance with their own privacy notices, including without limitation, New England Patriots LLC. If another company acquires, or plans to acquire, our company, business, or our assets, we will also share information with that company, including at the negotiation stage.
  2. NFL Family. We may share information with all members of the NFL family for use in accordance with their own privacy notices, including, without limitation, NFL Properties LLC, NFL International LLC, NFL Enterprises LLC, NFL Ventures, L.P. and NFL Ventures, Inc., NFL Productions LLC and the NFL member clubs for analytics and marketing purposes.
  3. MLS Family. We may share information with all members of the Major League Soccer (“MLS”) family for use in accordance with their own privacy notices, including, without limitation, Major League Soccer, L.L.C., Soccer United Marketing, LLC, and the MLS member clubs for analytics and marketing purposes.
  4. Other Disclosures with Your Consent. We may ask if you would like us to share your information with other unaffiliated third parties who are not described elsewhere in this policy.
  5. Other Disclosures without Your Consent. We may disclose information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws. We may also share your information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies, or to comply with your request for the shipment of products to or the provision of services by a third party intermediary.
  6. Public. Some of our Services may provide the opportunity to post user contributions or to provide user generated content (collectively, “User Contributions”).  If you decide to submit information on these pages, that information may be publicly available.
  7. Partner Promotions. We may offer contests, sweepstakes, or other promotions with third party partners. If you decide to enter a contest, sweepstakes, or promotion that is sponsored by, or affiliated with, a third party partner, the information that you provide may be shared with us and with them.  If information is shared with any third party or partner, their use of your information is governed by their privacy policy; our use of such information is governed by this privacy policy. We may also share your information with third parties to market their products or services to you if permitted by law.
  8. Third Party Ad Servicing and Audience and Traffic Measurement Services. We may use third parties to serve advertisements on the Services.  These third parties may set their own cookies or similar web technologies to collect information about users’ online activities over time and across different websites.  In some cases, the use of these third-party solutions involves the sharing of  your information for purposes of servicing you targeted advertising.  We may also disclose non-cookie-based information for advertising purposes, including for targeted advertising.  For example, we may disclose information to social networking platforms, so that they may send tailored communications via their platforms.  To manage your preferences, please see Your Choices and Data Rights, you may opt out here or in our Cookie Preference Center with respect to cookies.
  9. Service Providers. We may share your information with service providers. Among other things service providers may help us to administer the Services, conduct surveys, provide technical support, process payments, and assist in the fulfillment of orders.

YOUR CHOICES AND DATA RIGHTS

Some jurisdictions give you certain rights with respect to your personal information. Depending on the jurisdiction in which you reside or are located, you may have a right to make the following choices regarding your personal information:

  1. Access To Your Personal Information. You may ask us to confirm whether we process your personal information. You may also request access to your personal information by submitting a Data Privacy Request Form or contacting us at the address described below. If required by law, upon request, we will grant you access to the personal information that we have about you. You may also request that the personal information we have about you be delivered in a portable machine-readable format. We will grant such request if feasible and required by law. Note that California residents may be entitled to ask us for a notice describing what categories of personal information (if any) we share with third parties or affiliates for direct marketing.
  2. Changes To Your Personal Information. We rely on you to update and correct your personal information.  Our Services may allow you to modify or delete your account profile.  If the Service does not permit you to update or correct certain information, you may request that your information be modified by contacting us at the address described below. Note that we may keep historical information in our backup files as permitted by law.
  3. Deletion Of Your Personal Information. Typically, we retain your personal information for the period necessary to fulfill the purposes outlined in this policy unless a longer retention period is required or permitted by law.  You may, however, request information about how long we keep a specific type of information, or you may request that we delete your personal information by submitting a Data Privacy Request Form or by contacting us at the address described below.  If required by law we will grant a request to delete information, but you should note that in many situations we must keep your personal information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another one of our business purposes. Please note that we cannot delete your personal information without deleting your account. If you delete your User Contributions from the Services, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other users of the Services.
  4. Location Based Services. You may opt-out of location-based services at any time by editing the setting at the device level. If you would like us to change or delete personal information regarding your location (e.g., address) obtained in connection with sweepstakes or in any other way not relating to a device, please refer to the “Deletion of Your Personal Information” section above.
  5. Objection to Certain Processing. You may object to our use or disclosure of your personal information by contacting us at the address described below.
  1. Objection to Cookie Collections. You may refuse certain cookies by setting your browser to your preferred setting. You may adjust your user advertising preferences in your account profile (if applicable) or by changing your preferences in the Cookie Preference Center.
  2. Online Tracking. We do not currently recognize automated browser signals regarding tracking mechanisms, which may include “Do Not Track” instructions.
  3. Push Notifications. If you no longer wish to receive push notifications, you may turn them off at the device level. To ensure you receive proper notifications, we will need to collect certain information about your device such as the operating system and user identification information.
  4. Promotional Emails. You may choose to provide us with your email address for the purpose of allowing us to send free newsletters, surveys, offers, and other promotional materials to you, as well as targeted offers from third parties.  You can stop receiving promotional emails by following the unsubscribe instructions in e-mails that you receive.  If you decide not to receive promotional emails, we may still send you service-related communications.
  5. Promotional Mailings. If at any time you do not want to receive information, invitations, and/or offers  from us by standard mail, you can remove yourself from our mailing lists by emailing us (our contact information is below) with “NO SNAIL MAIL” in the subject line along with your name, address and zip code. Please note that our mailings are prepared in advance of their being sent. Although we will remove your name from our mailing list after receiving your request, you may still receive mailings from us that had been initiated prior to your name being removed.
  6. Promotional Text Messages. If you receive a text message from us that contains promotional information you can opt-out of receiving future text messages by replying “STOP.”
  7. Revocation Of Consent. If you revoke your consent for the processing of personal information then we may no longer be able to provide you Services. In some cases, we may limit or deny your request to revoke consent if the law permits or requires us to do so, or if we are unable to adequately verify your identity. You may revoke consent to processing (where such processing is based upon consent) by contacting us at the address described below.

Please note that opt-out requests may take some time to be effective where permitted by applicable law.  Your opt-out requests will not apply to messages that you request or that are not commercial in nature.

Note that, if required by law, we will require you to prove your identity.  We may verify your identity by phone call or email. Depending on your request, we will ask for information such as your name, the applicable organization that you last interacted with, or the date of your last communication with us. We may also ask you to provide a signed declaration confirming your identity. Following a request, we will use reasonable efforts to supply, correct or delete personal information about you in our files. Depending on your state of residence, if you disagree with how we handled a request, you may appeal our decision by contacting us with the subject line “Appeal.”

In some circumstances, you may designate an authorized agent to submit requests to exercise certain privacy rights on your behalf.  If you are an authorized agent submitting a request on behalf of an individual, you must attach a copy of a completed Authorized Agent Designation Form indicating that you are able to act on another person’s behalf.

How we protect personal information

No method of transmission over the Internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of your personal information. In the event that we are required by law to inform you of a breach to your personal information we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

Some of our Services permit you to create an account.  When you do you will be prompted to create a password.  You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether or not such access or use has been authorized by you.  You should notify us of any unauthorized use of your password or account.

On-Site Events

When you visit our location or attend an event at our location, we may capture your image, voice and/or likeness, including through the use of CCTV cameras and/or when we film or photograph you in a public location.  You should therefor expect to be filmed or photographed when you are in a public location.  In addition to describing how we capture and use your image, voice and/or likeness in this Privacy Policy, we may also display signs at any event on our premises indicating that you may be filmed or photographed.  We may use your personal information collected at an on-site location to produce, exhibit, advertise or otherwise use your image, voice or likeness in any and all media existing now or in the future as part of our commercial, advertising and marketing activities; and in the case of images or footage captured on CCTV cameras, to ensure the safety of the venue and individuals attending the event and for law enforcement purposes.  We may disclose your personal information captured at our location with any of the entities set out in this Privacy Policy, as described in Sharing of Information.  Please note that media representatives and other third parties that are unconnected with us may be independently filming or photographing you when you are at our location.   These entities are separate data controllers in  respect of your personal information, and we are not responsible for how those entities use your personal information or for what purpose.

Other important Information

The following additional information relates to our privacy practices:

  • Transmission of Information to Other Countries Within Kraft Group. We may transmit information between and among our affiliates.  As a result, your information may be processed in a foreign country where privacy laws may be less stringent than the laws in your country.  If applicable, you may request a copy of any Standard Contractual Clauses we use for the transfer of your data outside of the EEA, which includes the categories of information transferred, by contacting us using the contact information below.
  • Transmission of Information to Other Countries Outside of Kraft Group. In order to provide you with the Services and to improve our business operations, we may transmit information to our vendors in a foreign country where privacy laws may be less stringent than the laws in your country. If applicable, you may request a copy of any Standard Contractual Clauses we use for the transfer of your data outside of the EEA, which includes the categories of information transferred, by contacting us using the contact information below.
  • Transmission of Information to the United States. If you submit your personal information directly to one of our corporate affiliates in the United States, you agree to the transfer, storage and processing of your information in the United States.
  • Third Party Applications/Websites. We have no control over the privacy practices of websites or applications that we do not own.
  • Changes to This Privacy Policy.   It is our policy to post any changes we make to our privacy policy on this page.  If we make material changes to how we treat our users’ personal information, we will notify users through a notice on the Website home page and/or by email to users for whom we have an email address.  The date the privacy policy was last updated is identified at the top of the page.  If you choose to visit our website or use the Services, you are responsible for checking the privacy policy periodically.
  • Accessibility. If you are visually impaired, you may access this notice through your browser’s audio reader.
  • Children. We do not knowingly collect personal information from children as defined by local law. Our websites are not intended for children under 13 years of age (or such legally required higher age of children being lawfully able to provide consent). No one under age 13 (or such legally required higher age) should provide any information to, through, or on our websites. If we learn we have collected or received personal information from a child under 13 (or such legally required higher age) without verification of parental consent, we will delete that information or otherwise comply with applicable law. Gillette Stadium does not currently have account registration.  The Gillette Stadium app uses Ticketmaster login for certain uses.
